The Diesel Power Source Private Membership Association (“Association”), together with Diesel Power Source, LLC (“DPS”, “we,” “our,” or “us”), a member of the Association, is committed to protecting the personal information of its members and website visitors. This Association operates as a Private Membership Association in the private domain, organized under common law and protected by the First, Fourth, Fifth, Ninth, Tenth, and Fourteenth Amendments to the United States Constitution. United States, 251 U.S. 385 (1920) (barring use of records discovered through prior unlawful government conduct).
- DISCLOSURE OF INFORMATION
Constitutional Standard for Government Demands. We will not disclose member information, membership records, donor information, or internal Association records to any government entity, regulatory body, law enforcement authority, or judicial branch unless compelled by a lawfully issued order that has satisfied the constitutional requirements of exacting scrutiny as established by the United States Supreme Court. NAACP v. Alabama ex rel. Patterson, 357 U.S. 449 (1958); Americans for Prosperity Foundation v. Bonta, 594 U.S. 595 (2021); First Choice Women’s Res. Ctrs., Inc. v. Davenport, No. 24-781, 608 U.S. ___ (2026).
The Association will challenge any government demand for member information that does not meet this constitutional standard. The Association will seek injunctive relief, assert all available constitutional defenses, and pursue civil rights remedies under 42 U.S.C. § 1983 against any government actor who violates the associational privacy rights of the Association or its members. Any government entity or agent that violates these rights may also be subject to criminal liability under 18 U.S.C. § 242.
Member Records. Records maintained by the Association will be released only upon the written request of the member to whom they pertain and shall not be shared in the public domain without the express written consent of both the Association and the member.
Limited Non-Government Disclosures. We may disclose personal information in the following limited, non-government circumstances:
- To trusted service providers who assist us in operating the Website, processing payments, or fulfilling orders, provided they agree to keep your information confidential and use it solely for the purposes we specify.
- In connection with a business transaction (e.g., merger, acquisition, or sale), provided the successor entity agrees to be bound by the privacy protections set forth in this policy and the Association’s Articles of Association.
